The course aims at providing a basic understanding of the principles of Islamic finance and the means to structure Shariah-compliant transactions and products in international setting from an international legal perspective. This course will provide a basic introduction to Islamic jurisprudence and will focus on Islamic Finance Law as applied in international commercial financial transactions. Topics covered include:
- Basic Principles in Islamic Finance Transactions
- Process of Structuring Transactions & Deals to be Shariah compliant
- Transactional Contracts Bai, Sarf, Shirkah, Ijarah, Adl and Rahn
- Financing Contracts: Murabaha/Tawwaruq, Istisna and Ja’ala
- Intermediation Contracts: Mudaraba, Musharaka and Wakala
- Legal and Regulatory Framework in Islamic Capital Markets & Structured Products
- International Practice of Islamic Financial Law – from the perspectives of Malaysia, Singapore, London and the Middle East
- Corporate Governance, Regulation and Risk – Managing legal aspects
